Terms of Service

1. These terms
These terms govern reach12.com and the Reach12 service: the API for SMS and email and, when it is part of your account, the voice agent. By using Reach12 you accept them. If you use it for a business, you confirm that you may accept them for that business.
2. Early access
Reach12 is in early access. We open accounts one by one, features may change, and we make no uptime commitment unless we agree one with you in writing.
3. Your account and keys
We create your account and your API keys. Keep your keys secret. Anything sent with a key is your responsibility until you tell us the key may be compromised and we revoke it. Test keys never reach a carrier.
4. Fees
Early access is free unless we agree otherwise in writing. Before we charge anything, we will agree the price with you in writing.
5. You are the sender
You are responsible for every message and call you send through Reach12, for its content, and for your right to send it. In particular, you must:
- have the recipient's consent wherever the law requires it, including before sending advertising (in Israel, under section 30A of the Communications Law);
- label advertising as the law requires (in Israel, an advertising SMS must open with the word פרסומת);
- honor every request to stop, promptly and on every channel;
- not send spam, phishing, malware, or content that is unlawful, deceptive, harassing or hateful, or that infringes anyone's rights;
- not impersonate anyone;
- follow the laws on calls and recordings wherever the voice agent is used.
6. What Reach12 enforces
Reach12 refuses an advertising SMS without its label, advertising outside the contact hours, messages to addresses on your opt-out list, and anything beyond your daily limits. These are safeguards, not legal advice, and they don't replace your obligations under section 5.
7. The voice agent
When the voice agent is part of your account, it says it is an AI at the start of every call and answers honestly if asked. We won't configure it to hide that it is an AI.
8. Suspension
We may suspend an account or a key, without notice when necessary, if we believe it is being misused, puts recipients, carriers or the service at risk, or breaks these terms.
9. Carriers and delivery
Messages pass through carriers and providers we don't control, and they may delay, filter or refuse them. We don't guarantee delivery.
10. Your data
You own the data you send through Reach12. We process it to provide the service, as our Privacy Policy describes. You are responsible for having a lawful basis for that data and for telling your customers how you use it.
11. Our service
Reach12, its software and its brand are ours. While your account is active, you may use the service for your business under these terms.
12. No warranty
During early access the service is provided as it is and as available, without warranties of any kind, to the extent the law allows.
13. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential damages, lost profits or lost data, and our total liability is limited to what you paid us for the service in the 12 months before the event.
14. Your responsibility to us
You will compensate us for claims, fines and costs that arise from messages or calls you sent in breach of these terms or of the law.
15. Ending
You may stop using Reach12 at any time. We may end your access with 30 days' notice, or at once for a breach of these terms. What happens to your data then is described in the Privacy Policy.
16. Changes
We may update these terms. If a change matters, we will post it here with a new date and tell customers by email before it takes effect.
17. Law and courts
These terms are governed by the laws of the State of Israel, and the competent courts of the Tel Aviv district have exclusive jurisdiction.
